LANDMARK CASES RELATED TO THE RIGHT TO PRIVACY IN INDIA.

There have been several landmark cases related to the right to privacy in India. Some of the notable cases include:

  1. Kharak Singh v. State of UP (1964): This case established that the right to privacy is a fundamental right under the Indian Constitution, although it is not explicitly mentioned in the text of the Constitution.

  2. Gobind v. State of MP (1975): This case expanded on the Kharak Singh ruling and established that the right to privacy includes protection against arbitrary surveillance by the state.

  3. R. Rajagopal v. State of Tamil Nadu (1994): This case dealt with the right to privacy in relation to the publication of a book that contained details of the private life of a former chief minister of Tamil Nadu. The court held that the right to privacy can be overridden in the interest of the freedom of speech and expression.

  4. PUCL v. Union of India (1997): This case dealt with the use of phone tapping by law enforcement agencies. The court held that phone tapping constitutes a serious invasion of privacy and can only be carried out in accordance with the procedure established by law.

  5. Justice K.S. Puttaswamy (Retd.) v. Union of India (2017): In this case the Supreme court ruled that the right to privacy is a fundamental right protected under the Indian Constitution and it is an integral part of the right to life and personal liberty.

  6. Aadhaar case (2018): In this case the supreme court upheld the constitutional validity of Aadhaar, the Indian biometric ID system, but at the same time it also laid down certain restrictions on the use of Aadhaar and emphasized on the need for strong data protection laws to protect the right to privacy.
